利用規約
本利用規約は、合同会社チアイズクリエイション（以下「当ショップ」）が運営するウェブサイトおよびオンラインストアの利用条件を定めるものです。 お客様は、当ショップを利用し、商品を購入することにより、本規約に同意したものとみなされます。
第1条 販売商品について
当ショップでは、BGM・音楽素材などのデジタルコンテンツを販売しています。 商品はすべてデジタルデータであり、物理的な商品の発送はありません。 購入完了後、ダウンロードリンクまたはダウンロードページを通じて商品データを提供します。
第2条 注文・決済について
お客様は、注文時に正確かつ最新の情報を入力するものとします。 決済が正常に完了した時点で、注文が成立します。 価格は、各商品ページに表示された金額に従います。 価格は予告なく変更される場合がありますが、注文完了後の価格には影響しません。
第3条 返品・返金について
商品の性質上、デジタルコンテンツのダウンロード後の返品・返金・キャンセルは原則としてお受けしておりません。
ただし、以下の場合には個別に対応いたします。
- ダウンロードリンクが正常に機能しない場合
- 購入した商品と異なるデータが提供された場合
- ファイル破損など、当ショップ側に明らかな不備がある場合
上記に該当する場合は、購入日・注文番号・状況を明記のうえ、お問い合わせください。
第4条 利用ライセンスについて
購入したBGM・音楽素材の利用条件は、別途定めるBGM利用ライセンスに従うものとします。 購入により、お客様には楽曲の利用許諾が付与されますが、著作権その他の知的財産権が譲渡されるものではありません。
第5条 禁止事項
お客様は、当ショップの利用にあたり、以下の行為を行ってはなりません。
- 法令または公序良俗に反する行為
- 当ショップ、第三者、または他のお客様の権利を侵害する行為
- 商品データの不正取得、複製、再配布、販売
- 当ショップの運営を妨害する行為
- 虚偽の情報を用いた注文または問い合わせ
- その他、当ショップが不適切と判断する行為
第6条 知的財産権
当ショップに掲載されている楽曲、音源、文章、画像、ロゴ、デザインその他のコンテンツに関する著作権・商標権その他の知的財産権は、当ショップまたは正当な権利者に帰属します。 本規約およびBGM利用ライセンスで明示的に許可された範囲を超えて、これらを無断で使用することはできません。
第7条 免責事項
当ショップは、商品の説明、価格、表示内容、サービス内容について正確性を保つよう努めますが、常に完全性・正確性を保証するものではありません。 当ショップの利用または商品の利用によりお客様に生じた損害について、当ショップに故意または重大な過失がある場合を除き、当ショップは責任を負いません。また、間接的損害、逸失利益、機会損失等については、いかなる場合も責任を負いません。 また、通信環境、端末環境、外部サービス、決済サービス等に起因する不具合について、当ショップは責任を負いません。
第8条 サービス内容の変更・停止
当ショップは、必要に応じて、商品の内容、価格、販売方法、サービス内容を予告なく変更または停止することがあります。
第9条 個人情報の取り扱い
当ショップにおける個人情報の取り扱いについては、別途定めるプライバシーポリシーに従います。
第10条 規約の変更
当ショップは、必要に応じて本規約を変更することがあります。 変更後の規約は、当ショップ上に掲載された時点で効力を生じるものとします。
第11条 準拠法・管轄
本規約は日本法に準拠します。 本規約または当ショップの利用に関して紛争が生じた場合、当ショップ所在地を管轄する日本国内の裁判所を第一審の専属的合意管轄裁判所とします。
第12条 法務規約およびお問い合わせ
本規約に定めのない事項、または本規約の解釈に関する補足事項については、当ショップが別途定める「法務規約 / Legal Terms」を適用するものとします。 本規約と法務規約（Legal Terms）の内容が矛盾する場合は、本規約を優先するものとします。 当ショップの商品、ライセンス、利用方法その他に関するご質問は、お問い合わせフォームよりご連絡ください。

TERMS OF SERVICE
These Terms of Service govern the use of the website and online store operated by Chiais Creation LLC (hereinafter "the Shop"). By using the Shop and purchasing products, you agree to these Terms.
Article 1 — Products
The Shop sells digital content including BGM and music materials. All products are digital and no physical items will be shipped. After payment is confirmed, product files will be provided via a download link or download page.
Article 2 — Orders & Payment
You agree to provide accurate and up-to-date information at the time of purchase. Your order is confirmed when payment is successfully completed. Prices are as listed on each product page. Prices may change without notice, but will not affect orders already completed.
Article 3 — Returns & Refunds
Due to the nature of digital content, returns, refunds, and cancellations are not accepted after download.
However, we will handle the following on a case-by-case basis:
- The download link does not function properly.
- The file provided differs from the purchased product.
- The file is corrupted or there is a clear error on our part.
If any of the above apply, please contact us with your purchase date, order number, and a description of the issue.
Article 4 — License
The terms of use for purchased BGM and music materials are governed by the separately defined BGM License. Purchase grants you a license to use the music. Copyright and other intellectual property rights are not transferred.
Article 5 — Prohibited Uses
You may not engage in the following when using the Shop:
- Acts that violate laws or public order and morals.
- Acts that infringe on the rights of the Shop, third parties, or other customers.
- Unauthorized acquisition, reproduction, redistribution, or resale of product files.
- Acts that interfere with the operation of the Shop.
- Orders or inquiries using false information.
- Any other acts deemed inappropriate by the Shop.
Article 6 — Intellectual Property
All copyrights, trademarks, and other intellectual property rights related to music, audio, text, images, logos, designs, and other content on the Shop belong to the Shop or their respective rights holders. These may not be used beyond the scope explicitly permitted by these Terms or the BGM License.
Article 7 — Disclaimer
The Shop strives to maintain accuracy in product descriptions, pricing, and service information, but does not guarantee completeness or accuracy at all times. The Shop is not liable for any damages arising from use of the Shop or its products, except in cases of intentional misconduct or gross negligence on our part. In no event shall the Shop be liable for indirect damages, lost profits, or loss of business opportunity. The Shop is not liable for issues caused by internet connectivity, device environments, external services, or payment services.
Article 8 — Changes to Service
The Shop may change or discontinue products, prices, sales methods, or services without prior notice.
Article 9 — Privacy
The handling of personal information is governed by our separately defined Privacy Policy.
Article 10 — Changes to Terms
These Terms may be updated as needed. Updated Terms take effect upon publication on the Shop.
Article 11 — Governing Law & Jurisdiction
These Terms are governed by the laws of Japan. Any disputes arising from these Terms or use of the Shop shall be subject to the exclusive jurisdiction of the Japanese court having jurisdiction over the Shop's location.
Article 12 — Legal Terms & Contact
Matters not covered by these Terms, or supplementary interpretations, shall be governed by the separately defined "Legal Terms." In the event of conflict between these Terms and the Legal Terms, these Terms shall prevail.
